Parameters for allocation

Fast track

Intermediate track

Claim not suitable for small claims track.

Claim not suitable for small claims track or fast track.

Includes a claim for monetary relief for not more than £25,000.

Includes a claim for monetary relief for not more than £100,000.

Trial likely to last for no longer than one day.

If the case is managed proportionately, trial will not last longer than three days.

Oral expert evidence at trial likely to be limited to one expert per party in any expert field, and evidence in two expert fields.

Oral expert evidence at trial likely to be limited to two experts per party.

 

The claim may be justly and proportionately managed in the intermediate track procedure.

 

There are no additional factors making the claim inappropriate for the intermediate track.

 

Claims brought by one claimant against one or two defendants, or by two claimants against one defendant.

Exclusions for both tracks

  • Claims for mesothelioma or other asbestos lung disease;
  • Claims for clinical negligence, unless both breach of duty and causation have been admitted;
  • Claims for damages in relation to harm, abuse or neglect of or by children or vulnerable adults;
  • Claims that the court could order to be tried by jury;
  • Claims against the police involving an intentional or reckless tort, or relief or remedy in relation to the Human Rights Act 1998;
    • But note that this exclusion does not apply to road accident claims, employer’s liability claims nor accidental falls on police premises.
