Overview

Our team is one of the largest employment law practices in the UK. With Employment Practices Liability claims accounting for approximately 25% of the employment claims we handle nationally, we have built a dedicated EPL team which comprises of employment lawyers from each of our UK offices, as well as Dublin. Our experience of handling EPL claims spans both UK and global insurers.

We focus on reducing claims cycle time, and our knowledge and resource to review cases to provide an early assessment of liability, quantum and strategy with customised strategy documents ensures key issues are identified and actioned promptly.

Our EPL team regularly advises insurers on all coverage issues arising such as exclusions, condition precedents and retroactive cover, and works closely with other DACB insurance D&O experts to provide a seamless service.

We also offer advice on policy wording and are well placed to advise on legislative changes and market conditions which can affect labour and employment risk, and regularly advise underwriters on such changes.

Featured experience

  • Managing a complex claim against an insured professional body brought under a rare provision of the Equality Act 2010 regarding examinations and those with disabilities. Had the claim succeeded, it would have had significant consequences for the insured and its exam regime. We successfully defended the claim on all counts following a five day hearing.
  • Settlement of a 13 day race discrimination claim for a specialist insured, where there were 6 named respondents including the Insured, and the Claimant remained employed. The alleged damages claimed were significant. Settlement was reached at a quarter of what was being claimed, including the termination of the Claimant’s employment, as well as settlement of the claims against the Insured and the named individuals.
  • Settlement of a 10 day hearing to deal with claims of whistleblowing and automatic unfair dismissal. We achieved settlement of £150,000 (to include contractual payments), when the Claimant’s alleged losses were over £1m due uncapped losses and payment of share options.
