With the advent of new care models and changes in the commissioning structure, combined with the ongoing impact of the COVID-19 pandemic, the direction of the sector as set out in the NHS People Plan will introduce an array of workforce challenges, impacting public and private entities.

Leveraging our experience advising NHS England, a significant number of providers in the NHS, and leading organisations in the private sector, we offer more than just legal advice. We deliver a clear and pragmatic approach to navigating the uncertainties of this ever-changing landscape.

We support health and social care clients with issues ranging from individual matters like whistleblowing, harassment, grievances, and doctors' issues to strategic advice on industrial action/relations, mergers and acquisitions, integration, joint ventures, shared services, and outsourcing.

Our experience includes handling complex discrimination, transfer of undertakings, and detriment claims in employment tribunals. We've assisted clients with setting up businesses abroad and entering joint ventures with foreign organisations. We've also advised on other workforce-related issues, such as employing staff overseas, transferring domestic staff abroad, and bringing foreign staff to the UK using our dedicated pension and immigration experts.

We aim to resolve difficult internal situations proactively, preventing claims from arising or seeking amicable solutions. We also offer a People Pool service of expert HR and legal advisors who can assist clients in undertaking often complex and sensitive internal investigations or mediations. Featured experience

  • Supporting NHS England, NHS Trusts, and NHS Foundation Trusts in managing nursing, medical and other strikes in 2022/23. We have supported clients in many ways including strike preparation training, preparing derogations to ensure patient critical work continues on strike days and working with our healthcare regulatory colleagues on consultants' responsibilities to provide supervision during strike action.
  • Advising NHS England on a significant change programme involving transfers of high levels of staff in from other bodies. We are working to ensure a smooth transition, providing advice on the complex legal and policy background to this public sector transfer.
  • As the NHS strives to achieve systems working we have been providing advice to many NHS bodies on the workforce answers to make this happen. That means we have been at the forefront of developing models and agreements to facilitate staff sharing and integrated care systems working: including NHS and NHS/independent sector staff sharing agreements, lead employer arrangements, joint bank agreements and shared service agreements.
