Our highly experienced team has handled some of the largest, most high profile and technically-demanding D&O disputes. We defend directors and officers of corporations, SMEs, and non-profit entities in a variety of claims including allegations of breach of duty, fraud, wrongful trading, bribery and corruption, tax evasion and money-laundering.

We advise on director disqualification proceedings and regulatory investigations. We also advise insurers and reinsurers on complex policy coverage issues including non-disclosures, policy exclusions, aggregation and policy response.

Our international reach means we can swiftly assemble experts in multiple jurisdictions to provide a coordinated response to international and cross-border disputes, and act as monitoring counsel in large international loss programmes.

We draft policy wordings and advise on risk management, corporate governance, regulatory compliance as well as emerging risks such as artificial intelligence, ESG-related claims, cybercrime and data theft.

  • Representing London Market Reinsurers subscribing to the D&O reinsurance programme across multiple years of account for a state-owned oil company in Colombia, in connection with a multi-billion-dollar claim made by the Colombian authorities against various directors of the company relating to the alleged mismanagement of a project to redevelop an oil refinery. This matter is one of the largest and highest profile claims in the London market.
  • Advising D&O insurers on policy coverage in relation to the largest corruption case in Norwegian history.
  • Defending a director accused of breaching their directors' duties by planning to set up a competing business and diverting business opportunities.
  • Advising insurers on policy coverage and indemnity of directors following a highly publicised failed collective investment scheme incorporated in Guernsey.
