Heather Durston-Hillyer is a clinical risk lawyer and partner in our Winchester office, and since moving to the firm’s Winchester office in 1997, she has specialised solely in defending clinical negligence claims involving health clients.
As well as NHS Resolution (formerly the NHS Litigation Authority) work on behalf of NHS Trusts, she undertakes work for the Medical Defence Union involving both GPs and private medical practitioners. She is a Nominated Partner for NHS Resolution.
She is currently involved in many complex and high value matters including those involving brain and spinal injury to both adults and children. Heather has particular expertise in birth injury claims involving cerebral and erb's palsy as well as wrongful birth.
Heather's experience includes:
Concluding settlement on behalf of a NHS Foundation Trust in a complex wrongful birth claim, pleaded at £10M where damages were claimed by both parents for the cost of bringing up the disabled child throughout his life time - the claim was settled on the eve of Trial for £6 million;
Advising on and drafting complex Periodical Payments Orders in birth injury and other claims where damages payments continue through a Claimant's lifetime;
Regularly advising and lecturing on risk management issues affecting NHS trusts.
Heather qualified in 1995 and joined DAC Beachcroft LLP's legacy firm, Wansbroughs Willey Hargrave in 1996.
