  • Biography

    Dom's practice extends to a wide range of commercial insurance areas, and he has strong experience in advising clients across a range of professions.

    Dom has extensive experience in advising insurance brokers facing E&O claims, including following complaints made against the broker to the Financial Ombudsman Service or following claims made under the Professional Negligence Pre-Action Protocol. In addition, Dom advises brokers, in conference or by in-person training sessions, about risk management and claim prevention. 

    Dom also specialises in defending a wide variety of claims made against accountants, property management professionals, law firms and solicitors. He also regularly acts for solicitors in the defence of claims in the context of corporate /commercial transactions, residential and commercial conveyancing, and previously took a prominent role in advising solicitors and their indemnity insurers on ground rent claims. Dom also has experience in the context of SRA investigations, having previously assisted a law firm in successfully avoiding SRA sanctions for its role in an unregulated SPV investment scheme worth over £30m. 

    In addition, Dom deals with policy and coverage matters, including advising upon major policy coverage disputes in relation to professional indemnity, Directors & Officers policies, and material damage / business interruption. 

    Dom's relevant experience includes advising:

    • A national firm of insurance brokers on a litigated £3.4m claim in which the claimant alleged that its business activities had been misrepresented by the broker to insurers pre-inception of the insurance policy
    • A national law firm in the context of an SRA investigation in respect of its role in an unregulated SPV investment scheme worth over £30m
    • A firm of accountants in respect of the advice and management it provided to a company entering into administration, which had resulted in a c. £600,000 claim against the accountants by the disappointed directors 
    • An insurance broker in the context of a £5.4m claim in which the broker was blamed by the insured for the avoidance of several of its policies, following two fires at the insured’s premises. The claim concerned the broker’s alleged failure to explain key policy terms and conditions, elicit key information, and make full disclosure to insurers pre-renewal of the relevant policies.
