Biography
Ciaran has over 15 years' experience dealing with civil and commercial litigation and specialises in defending regulatory investigations, prosecutions, and civil claims on behalf of large, multinational corporations. He has particular expertise in the leisure and construction sectors, and has been recognised by Legal 500 since 2018 for regulatory and major loss casualty work.
Ciaran manages relationships with blue chip corporate clients, developing connections with senior staff throughout the organisations to cement close relationships. He provides added value through training and working with clients to improve their safety management systems.
Ciaran's relevant experience includes:
- Advising a large multinational corporation during an 8-year HSE investigation and prosecution arising from the death of an employee. This involved including appealing an improvement notice, representing clients at WP meetings with the HSE, resisting notifications of contravention, dealing with the family’s civil claim, and representing clients at a three-week Newton Hearing.
- Successfully defending a sole director from a local authority prosecution following a fatal drowning at a holiday park in the Lake District
- Advising a major hotel chain on complying with HSG179 (Health and safety in swimming pools), including changes required to its safety management system and physical modifications to its larger pools to improve defensibility
- Successfully persuading the HSE not to prosecute a steel stockholder following a fatal accident despite the company accepting three improvement notices relating to work processes directly connected with the incident.
- Instructed by a leading commercial refrigeration manufacturer to advise in an Environment Agency investigation not covered by their insurance, in recognition of the high-quality work provided in a separate insurance-backed case for the same company. Successfully persuaded the Agency not to take enforcement action despite the company admitting technical breaches.
- Successfully overturning a Metropolitan Police notice issued to a hotel client for alleged failure to guard against child sexual exploitation
- Securing several trial wins for a client facing a high volume of Highways Act claims and for another client dealing with injuries to employees sustained whilst restraining prisoners. Utilised the successes in those cases to persuade other claimants to discontinue their own cases.
