Jonathan has particular experience in AI, cyber, technology, war, terrorism, property, casualty, and financial/professional lines. His expertise spans contentious and non-contentious insurance and reinsurance matters, delegated authority and distribution arrangements, product governance, and financial services regulatory compliance.
Jonathan regularly contributes to industry thought leadership through publications, market commentary and speaking engagements on insurance, reinsurance, cyber, AI, and emerging risks.
Jonathan's experience includes:
- Advising an insurer on coverage under a marine hull policy, including the operation of a cyber exclusion clause, in relation to a claim exceeding US$60 million arising from the grounding of a vessel in the Middle East
- Advising a reinsurer on coverage under a facultative reinsurance policy, including the operation of war and terrorism exclusions, in relation to a claim pleaded in excess of US$1 billion arising from the Gaza-Israel conflict
- Advising an insurer on the insurability of one of the largest GDPR fines imposed to date, involving complex regulatory and public policy considerations
- Advising an insurer on the regulatory structuring of group insurance arrangements for major corporate policyholders, including banks, analysing FCA perimeter guidance, regulated activities, the ‘by-way-of-business’ test, and applicable exemptions
- Leading negotiations on behalf of underwriters on cyber war clauses for a tech PI and cyber renewal, advising on risk allocation and market positioning
- Advising insurers on AI-related coverage issues, including drafting product enhancements and exclusions addressing emerging regulatory and liability risks
