  • Biography

    Eloise has more than 10 years' experience in employer's and public liability matters. In recent years, she has expanded her practice into the fields of clinical negligence and fatal accidents. Eloise's clinical negligence experience includes near-fatal labour injuries, surgical negligence (basal cell carcinoma), delayed diagnosis, and fatal aspiration pneumonia.

    In addition to her court work, Eloise has a strong paperwork practice, including matters worth over £200,000. She is adept at handling high value claims involving multi-disciplinary expert evidence and has advised in multiple conferences with both expert and client. Furthermore, she can settle pleadings and schedules involving complex causation and quantum issues, including Ogden calculations.

    Eloise welcomes instructions in costs proceedings and applications, including detailed assessments and applications for wasted costs and non-party costs orders. In addition to this experience, she has a good working knowledge of the fixed costs regimes (pre- and post-October 2023) and the interplay with QOCS. She has obtained numerous enforceable costs orders.

    Fraud

    Eloise has considerable experience in fraud matters, arising predominantly out of road traffic accidents and employers' and public liability claims. Having joined 8DB, DACB’s in-house barrister chambers, after more than seven years practising at the self-employed Bar, Eloise has been instructed by a range of counter-fraud teams and insurers, drawing together the best of various strategies and her extensive court experience.

    Eloise has persuaded the court to make findings of fundamental dishonesty, including allegations of phantom occupancy and staged or fabricated accidents, on a number of occasions. She has secured several mid-trial drop hands offers from claimants and her cross-examination has been described by the judiciary as "detailed and strong forensic examination".

    Featured Experience:

    Eloise’s notable fraud cases include:

    • E v E and Z (2024) – Eloise secured the dismissal of the claimant's claim for injury arising out of an RTA. The claimant was found to be a thoroughly unreliable witness, who had changed her evidence in cross-examination, seeking to improve her position. The judge commented that Eloise's cross-examination was conducted with "commendable brevity but also thoroughness".
    • P and P v O (2022) – Eloise negotiated settlement in terms that the claimants do pay the defendant's costs, following her cross-examination of the claimants and their subsequent drop hands offer.
    • K v U (2021) – Eloise obtained findings of fundamental dishonesty and phantom occupancy in this liability-disputed matter.
    • C v K (2021) – Eloise secured a finding of fundamental dishonesty in this RTA matter in which the court accepted that the collision was caused by a "deliberate and calculated act of the claimant", with the judge also stating that she was unable to accept that the claimant had sustained any injury.
    • M v R (2020) – In this RTA matter, Eloise obtained a finding of fundamental dishonesty, with the judge finding with "no hesitation" that an alleged RTA had not taken place. Eloise highlighted inconsistencies in bank statements, odometer readings, and the claimant's accounts surrounding the alleged injuries.
