Financial Services in 40 Webinar: Handling non-financial misconduct in practice

Financial Services in 40 Webinar: Handling non-financial misconduct in practice

📅 26 November 2026 12:00 - 12:40📍Webinar

You are invited to the first of our regular series of 40 minute webinars, Financial Services in 40, giving a focussed practical treatment of current topics in UK financial services regulation.

From 1 September 2026, with the FCA's new rule impacting solo-regulated firms, non-financial misconduct is clearly in scope of the FCA's Conduct Rules and the fit and proper standard. For banks this has long been the case but banks now need to take into account the FCA's new guidance on non-financial misconduct.

Our speakers will draw on their extensive experience advising banks and other clients, with scenarios based on that work, to explore the following key issues:

  • When is non-financial misconduct serious enough to be a potential breach of the Conduct Rules?
  • When will non-financial misconduct involve a lack of integrity or failure to exercise due skill, care and diligence?
  • Distinguish between behaviour in a work context versus personal/private life.
  • When will a Conduct Rule breach also mean an individual fails to meet the fit and proper standard?
  • When will behaviour in personal/private life breach the fit and proper standard?
  • How can managers satisfy the enhanced responsibilities on them to tackle non-financial misconduct?
  • Scoping investigations into non-financial misconduct
  • Ensuring fair and consistent decisions about breaches of the Conduct Rules and the fit and proper standard.
