The Personal Injuries (NHS Charges) (Information Provision and Amounts) (Amendment) Regulations 2026 and Personal Injuries (NHS Charges) (Amounts) (Scotland) Amendment Regulations 2026 which are effective from 1 October 2026 will increase the charges recoverable by the NHS in England & Wales and in Scotland for injuries occurring on or after that date. The new figures are set out in the table below and show an increase of between 1.87% and 2.03%. These numbers contrast with the last set of increases to these figures, in October 2025, which ranged between 4% and 4.3%.

These increases impact on claims inflation and compensators must ensure that reserves for accidents which occur on or after 1 October 2026 reflect the increased level of charges.
