Biografía
On the contentious side, Linnea has dealt with employment tribunal claims for large NHS organisations including ambulance trusts, as well as local authorities, police forces, and major private companies, including complex discrimination claims and sensitive whistleblowing claims. She is currently involved in the defence of a mass equal pay litigation claim.
On the non-contentious side, Linnea regularly provides employment support on corporate transactions and her advice includes advising on the application of TUPE, drafting and negotiating warranties and indemnities in outsourcing agreements and share/business purchase agreements, and advising on employer obligations under TUPE.
Further, Linnea has advised on and guided a variety of organisations through investigations of misconduct, absence, and grievance issues. Linnea has also acted as an investigator herself.
Linnea also provides general HR guidance and strategy advice on how to deal with matters such as breakdown of relationships, redundancies, and restructures.
Featured experience:
- Being part of a team defending one of the UK’s major supermarket chains in connection with a mass equal pay litigation claim, where Linnea leads the "comparator workstream"
- Acting on behalf of an NHS organisation in connection with a large-scale outsourcing contract, where the previous service was split up into two different contracts. This work included advising on strategy and the application of TUPE in respect of organised grouping and assignment, as well as change of client. It also involved negotiating and drafting TUPE and employment provisions, including bespoke risk-sharing clauses.
- Analysing all evidence and processes in respect of grievance and misconduct issues involving a police force’s Deputy Head of Legal and advising on risk of any potentially successful employment tribunal claims resulting from the handling of those matters; defending the resulting tribunal claim and achieving a successful resolution
- Successfully defending a multi-day whistleblowing tribunal claim involving a large number of alleged disclosures and detriments. The claim originally included four different respondents and involved a contentious and protracted disclosure exercise.
- Advising an organisation on strategy in managing the employment and potential termination of employment of a bipolar employee whose conduct led to a series of medical suspensions and breakdown in relationships
