    Michelle is a Barrister in our specialist advocacy service, 8 DAC Beachcroft Buildings (8DB).

    Michelle specialises in civil litigation with a focus on personal injury litigation, employer and public liability claims, disease claims, motor claims, recoveries and civil enforcement. Michelle also has experience of data protection claims and clinical negligence. She has over 11 years’ experience advising clients across a range of sectors. Michelle has appeared in Courts of all levels on interim and final hearings including fast track and multi-track cases for both claimant and defendant clients. Michelle regularly provides written advice to clients on both prospects and quantum. She also has vast experience drafting statements of case and other court documents.

    Micelle has also compiled and presented a number of seminars to members of the Bar, the Solicitors profession and undergraduates. She has covered a wide range of topics including Defamation and the Internet, Sports Injury and the Law, Changes in the Courts System, Fraudulent Personal Injuries Actions and tactical use of the MOJ portal procedure.

    Relevant experience/notable cases includes:

    • McF & Another v Q: Michelle appeared on behalf of the Defendant. The claim was a road traffic accident where breach of duty was admitted but causation was denied. Michelle succeeded in having the claim dismissed on the basis that neither Claimant could establish causation of injury.
    • M A v T: Michelle acted for the Defendant at a stage 3 final hearing and succeeded in having the claim for PSLA assessed at nil. The Claimant had relied on a medical report which provided that both the position on causation and a prognosis would be finalised following the receipt of medical records. The medical records were never obtained and the Court accepted the submission that then resulted in a failure to establish causation.
    • A v T: Michelle acted on behalf of the Defendant. The Claimant was claiming damages for breach of contract arising out of a spoiled holiday. The Court accepted the argument that the factors leading to the holiday being ruined (i.e. unavoidable action taken by the government of the destination country) were specifically dealt with in the contract and therefore did not attract damages. The claim was dismissed.
    • W v A: In acting for the Defendant Michelle succeeded in having the entire credit hire claim dismissed. Under cross-examination the Claimant accepted that she did not understand that this was a credit hire agreement, that she was misled about the terms of the agreement and would neither have entered into the agreement had she known nor would she pay the charges if presented with a bill now. The Judge accepted that the credit hire agreement was unenforceable against the Claimant and so the Defendant was not obliged to compensate her for it.
