Rebecca Bailey

Rebecca is an insurance litigation and dispute resolution lawyer based in London specialising in contentious insurance and reinsurance matters, including policy coverage analysis and domestic and international dispute resolution.

She has over 20 years’ experience advising (re)insurers in high-value complex coverage and defence disputes across a number of classes of business, including Professional Indemnity, Directors & Officers, Financial Institutions , Cyber, Political Risk and Warranty and Indemnity. Rebecca also regularly advises insurers on coverage in respect of contingency and event cancellation disputes and is particularly experienced in advising on claims arising out of COVID-19.

Rebecca has extensive experience of the London insurance market, having completed secondments with several leading London market insurers.

Rebecca’s cases often have an international element and she has worked with local lawyers in jurisdictions including the UAE, the USA, Canada, Australia, France, Belgium, Germany and Finland.

Recent experience includes:

• Advising insurers across two different years of account on coverage and policy attachment in relation to allegations of professional negligence against a City law firm in connection with an underlying marine dispute involving issues of English and French law
• Successfully defending a City law firm through to the Court of Appeal in striking out a multi-million pound claim for alleged professional negligence arising out of advice provided in the context of administration proceedings.
• Advising reinsurers on political violence reinsurance policy coverage following the US withdrawal from Afghanistan in September 2021.
• Advising contingency insurers on the application of standard Communicable Disease exclusions and extensions and the application of Government restrictions in different jurisdictions across a range of cancellation / postponement claims, including rock/pop concerts and international tours, festivals, TV shows/films and international industry exhibitions.
• Advising D&O insurers on policy coverage in connection with a regulatory investigation into its multinational insured.
• Acting for warranty and indemnity insurers in the defence of multi-million pound High Court proceedings.
• Advising cyber insurers on policy coverage following a ransomware attack on its insured and the notification of various data breach claims.
