Jonathan Mitchell

Jonathan specialises in and advises on all aspects of personal injury and disease claims, particularly complex and unusual/high-value employers' liability claims, disease claims, and public liability cases. He acts on behalf of insurers and corporate clients in all types of disease claims, with a particular focus on short tail claims. He also advises clients based outside of the jurisdiction.

He has over 7 years’ experience advising clients across a range of sectors including those operating in the construction and retail and leisure sector. He also acts on behalf of Local Authorities.

Jonathan focuses on defending novel and complex claims, including claims arising out of exposure to asbestos, food poisoning claims, work related upper limb disorders, cumulative back, asthma, silicosis, noise-induced hearing loss (NIHL) and stress related illnesses. He has extensive experience of dealing with asbestos litigation in the High Court. Jonathan has developed a niche expertise in advising on and defending claims brought under the Equality Act 2010.

Jonathan deals with claims for a number of large and well known corporate clients, and has a full understanding of their complex and challenging insurance history. He also works for many of the UK’s major insurers and deals with claims from companies based across Europe and in the USA.

Jonathan works with clients to manage complex claims, finding practical and cost effective ways of resolving litigation in order to protect against reputational damage.

Relevant experience includes:

  • Achieving a saving of over £1 million for a Government body on a high value complex claim.
  • Successfully defending a claim for mesothelioma brought against a multi-national company in which the corporate history was in dispute. A 6 figure saving was achieved for the client.
  • Advising insurers on making applications for Fundamental Dishonesty in QOCS cases to recover costs in cases involving fraud concerns.
  • Advising a Local Authority in respect of a claim for mesothelioma where exposure occurred whilst the Claimant was a school pupil.

In addition, Jonathan regularly speaks at events. He presented at the DACB disease future series on stress in the workplace and also delivered WebEx training on Covid-19. This training was focused on the impact of Covid-19 on different sectors. Jonathan has produced articles that have been published by Construction News and Insurance Day.
