Hermanto specialises in litigation and dispute resolution, with a strong focus on handling claims for aviation insurers and reinsurers.    

Hermanto is based in our Singapore office and has more than a decade of experience in advising clients in Indonesia and Singapore.  His experience ranges from the handling of airline to general aviation claims.  He has been involved for aviation insurers in two Indonesian major losses (an Airbus 320-200 loss in 2014 and a Boeing 737 Max 8 loss in 2018). His general aviation experience is in claims handling, both subrogated recovery actions and defence claims, across a range of fixed wing (Bombardier BD700, DHC6-300 Twin Otter, Cessna Caravan 208B and PAC P-750 XL) and rotor wing (Bell 206B and Bell 429) type aircraft. 

In addition to his aviation practice, Hermanto’s experience extends to the handling of claims in the marine, construction and energy sectors involving Indonesian law and/or jurisdiction.

Hermanto is an Indonesian qualified lawyer, admitted to the Indonesian Bar in 2010.  He is also a Registered Foreign Lawyer in Singapore.  He is a native Indonesian language (Bahasa Indonesia) speaker and fluent in English.

Relevant  experience includes:

  • Advising insurers on Indonesian general aviation claims arising from air accidents and incidents to include the loss of a Bell 429 helicopter at Morowali, Sulawesi, Indonesia, a Cessna Grand Caravan 208B near Oksibil, Papua, Indonesia and a PAC-750XL aircraft in Oksibil, Papua, Indonesia.
  • Handling liability claims for aviation insurers arising from the crash of a Boeing 737 Max 8 aircraft in the Java Sea, Indonesia. In October 2018 with the loss of all 189 persons (passengers and crew) on board.
  • Bringing a successful subrogated recovery action for aviation insurers, against a ground handling company and arising from damage occasioned to a Bombardier aircraft in an airport ground collision incident.
  • Successfully defending an Indonesian flag carrier in a denied boarding claim brought by a high-profile passenger. In which the claim was pursued through the Indonesian court system up to the Supreme Court.
  • Advising reinsurers on issues relating to ex-gratia payments, made by the insurer of a seaport operator and in relation to an accident involving a twin screw tug.
  • Advising a Japanese company in the light of the Coronavirus pandemic on its rights pursuant to force majeure clauses under multiple contracts. The effect and implementation of legislation enacted by the Indonesian Government, to tackle the spread of the Coronavirus and the impact of the same on the performance of the contractor's work.
  • Advising a vessel charterer in relation to prevention measures taken by the Indonesian Directorate General of Customs and Excise and the associated auction of 45,090 MT of nickel ore cargo.
  • Advising an international oil company in a potential claim against an Indonesian drilling company, for the delay in performance of the contractor’s obligations under a drilling contract.
