Daniela McGowan

Daniela McGowan specialises in professional liability insurance.

She has over 9 years’ experience advising clients across a range of sectors including claims against solicitors / barristers, brokers and construction professionals including main contractors, architects and engineers.

Daniela has experience of dispute resolution and specialises in advising on the defence of professional liability claims. Her practise includes coverage and policy advice, defendant construction professional indemnity claims, defendant solicitor professional indemnity claims and broker professional indemnity claims, including overage.

She has particular expertise in handling multi-party disputes and liability claims arising on construction projects, covering professional indemnity policies. She joined DAC Beachcroft in January 2023 after over 6 years in a leading national firm, where she specialised in professional indemnity claims.

Relevant experience includes advising:

• On a significant claim against a main contractor relating to water ingress in student accommodation resulting in damage of £15million+
• A structural surveyor relating to the pipework in a residential housing estate. Consideration of policy issues under the Third Parties (Rights Against Insurers) Act 2010 arose.
• Various insurers and solicitors on “Friday fraud” claims following the Dreamvar case, resulting in significant financial recovery for insurers.
• Solicitors and insurers on a group action brought by investors who had invested in buy-to-let properties including Ponzi scheme allegations against the defendant solicitors
• Insurers in a policy arbitration which involved allegations of dishonesty and fraud against the directors of the solicitor firm. Consideration of aggregation and declinature involved.

Daniela is a member of the CPD Committee for the Manchester Chartered Insurance Institute (CII).
