Our Take: This may be a first instance decision but it certainly makes life far more difficult for those seeking to sue professionals for advice given prior to the global financial crisis. Such attempts are still being made, but if this decision gains momentum within the judiciary the bar may have been raised too high for those active in the sub-prime/self-certification sector.
