Rebecca Maby

Rebecca specialises in the defence of complex liability claims for the public sector.

She has over 15 years’ experience working in this area, and advises clients including local authorities, police forces and their insurers.

Rebecca has particular expertise in social services abuse claims and other cases involving complex duty of care issues. She has handled Police malfeasance claims for many years.

Rebecca is experienced at dealing with claims arising under the Human Rights Act 1998 and is also regularly instructed by her clients in respect of data breach claims.

Rebecca regularly speaks at client events and seminars, and delivers bespoke training sessions to her clients.

Relevant experience includes:

  • Handling social services “failure to remove” claims for many local authorities for several years. Rebecca is used to handling these complex, sensitive claims, and is highly knowledgeable in this field. Recent instructions include handling a £1.5 million social services failure to remove claim, and advising upon the existence of a duty of care following the Supreme Court decision in CN v Poole Borough Council.
  • Recent successful application to strike out a Human Rights Act claim on behalf of a local authority. The claim arose from alleged failures by the local authority in the course of care proceedings, which it was alleged infringed the claimants’ rights under Article 8.
  • Police claims - regularly instructed in numerous claims for malfeasance, claims involving alleged breaches of the Human Rights Act 1998, and claims involving breaches of data protection. Recent instruction in £1 million claim for alleged breach of the Data Protection Act 1998, leading to wrongful arrest, on behalf of a regional Police force.
