Gavin Morgans

Gavin specialises in all aspects of real estate law with a particular focus on development.

He has over 8 years’ experience advising clients on all aspects of land acquisition/disposal for residential and mixed-use development ranging from short term projects to strategic developments.

Gavin primarily acts for national PLC house builders and developers advising on conditional contracts and option agreements, joint venture and promotion agreements, development agreements and overage provisions. He also acts for housing associations acquiring sites for development and purchasing affordable units by way of ‘golden brick’ arrangements.

Relevant experience includes:

• advising a national PLC house builder on a joint venture to purchase a 4,000 unit multi-phased site with mixed-use local centres, primary schools and associated infrastructure. The work involved drafting and negotiating conditional contracts, numerous overage provisions and legal charges for deferred payments of the purchase price
• advising a national PLC house builder on all aspects of an existing 800 unit joint venture development site including dealing with partition transfers, Section 106 disposals and leases and the sale of affordable units to a national registered provider
• advising a national registered provider on its acquisition of a site for the development of affordable units including securing grant funding from the Welsh Assembly Government
