Elke De Mariassy

Elke specialises in high value personal injury and fatal accident claims. She handles cases up to and including catastrophic injury, involving complex motor, employers liability and public liability claims.

She has over 19 years’ experience advising a range of insurance client’s across a range of sectors including construction, manufacturing, fleet, and the public sector.

Elke’s specific experience includes claims involving brain injury, severe lower and upper limb injuries, spinal injury, psychiatric injury and chronic pain. She has a special interest in accidents involving falls from height, manual handling / machinery and construction site related injuries, as well as road traffic accidents and public liability.

Relevant experience includes advising:

• Defence of a fairground operator where a member of the public claimed to have suffered severe, life changing upper limb and psychiatric injuries as a result of alleged defects to a fairground ride. The Claimant discontinued after witness and expert evidence exchange.
• Settlement of a brain injury claim brought by a pedestrian at 50% of the pleaded value due to arguments of contributory negligence.
• Settlement of a severe lower limb claim at around 10% of the pleaded value due to successful arguments of causation, dishonesty and exaggeration, and securing set off of 2 years’ defence costs against the claimant’s damages and costs.

Elke conducts training sessions for insurer clients, recent training sessions have included dealing with chronic pain claims.
