Ben Daniels leads the Commercial Dispute Resolution team in Bristol.
He is a litigation lawyer with a particular interest in telecommunications and financial services as well as being a recognised expert on fraud and urgent injunction work. He specialises in the protection of assets at risk as a result of fraud, the protection of data and confidential information, defamation and reputational risk, and the resolution of complex contractual disputes.
Within the financial services industry, Ben has particular experience in life assurance industry disputes, acting for product providers and IFA networks in mis-selling claims, and all litigation that is affected by the Financial Services & Markets Act 2000.
His recent cases include:
Defending a global insurance company and its wealth management subsidiary against a number of multi-million pound claims brought by ex-executives and advisers in connection with an equity participation scheme;
Defending a life assurance product provider and a financial services distribution network in respect of customer claims arising out of a £10m Ponzi style fraud operated by a rogue financial adviser;
Acting for a financial services distribution network in connection with an internal investigation, action against brokers accused of the illegal sale of customer data, and handling reputation management issues arising (including preventing publication of allegations injurious to the client by a national newspaper);
Obtaining an injunction and doorstep search order on behalf of a pay-day loan company against an ex-senior consultant engaged in the misuse of confidential information and the establishment of a competitor business;
Defending proceedings brought in connection with a joint venture company 50/50 owned by our international based plc client. Both sides sought remedies which would trigger the buyout of the other joint venturers' shares in the business (which distributes £3 billion of healthcare products per annum). Successfully resolved after mediation.
