DAC Beachcroft Launches Motor Whiplash Reforms Microsite

Published 3 June 2021

International law firm DAC Beachcroft has launched a new online platform to support insurers’ claims teams in navigating their way through the new rules and procedures introduced as a result of the Government’s new package of “whiplash” reforms that went live on 31 May 2021.

Developed by Kevan Smith, Partner, and Stephanie Welsher, Associate, in DAC Beachcroft’s Motor Injury team, the firm’s new Motor Whiplash Reforms Microsite draws together a wealth of practical information, tools and materials, including:

  • guidance on the main differences between the MOJ Claims Portal and the new Official Injury Claim (OIC) Portal
  • tariff and non-tariff damages
  • answers to frequently-asked questions; and
  • an interactive flow chart showing the different directions that a claim can progress through with the new process.

Commenting on the new online resource, Kevan Smith, said, “The new rules and processes brought in as a result of the Government’s whiplash reforms bring huge changes for all in the claims arena. Our new microsite will provide insurers with an interactive live resource of materials and support, capable of adapting to behaviours on the new OIC Portal as they emerge.”

The package of reforms was introduced by the Government to tackle the high number and costs of whiplash claims and the impact these have on the cost of motor insurance premiums. The changes include:

  • Launch of the Official Injury Claim Portal
  • Whiplash claims to be valued by way of a statutory tariff
  • An increase in the small claims track for RTA personal injury claims to £5,000
  • A new RTA Small Claims Pre-Action Protocol and Practice Direction 27B

To help those making a claim, DAC Beachcroft has also published a simple guide that explains where a claimant should start their claim and whether it is suitable for the OIC Portal.
