DAC Beachcroft advises on strategic partnership between Sussex Community NHS Trust and Capita

A team of health lawyers at international law firm DAC Beachcroft has advised Sussex Community NHS Trust (SCT) on its strategic partnering arrangement with Capita.
It is the first arrangement of its type in the NHS. Under the arrangement, SCT and Capita will work as partners to identify efficiencies and better ways of working, and accelerate the pace by which improvements are achieved.
Commenting, Carol Sumner, Consultant in DAC Beachcroft’s health team, said: "This arrangement has no precedent in the NHS to date, so was an exciting project to be involved in.
"DAC Beachcroft advised on the procurement strategy and process (including with dialogue with bidders), and advised the Trust through the evaluation process to select a preferred bidder. We drafted bespoke project agreements for three initial areas of strategic focus between the parties, working closely with the Trust's financial advisors on the payment mechanism. As the strategic relationship develops further projects will be developed and implemented during the term."
SCT’s director of finance, facilities and estates, Jonathan Reid, said: “The strategic partnership will help us move forward in our work to realise our vision and deliver our strategic objectives.
“DAC Beachcroft has given us invaluable advice and guidance throughout the process, and we’re grateful for the professionalism and expertise Carol and her team have exhibited at all times.”
The deal was signed just before Christmas, and the strategic partnership commenced on 6 January 2014.
