With the increasing focus on legislation and prosecutions following serious or fatal collisions, there has been a significant increase in the number of drivers being interviewed under caution and therefore requiring immediate assistance. What we do

Our specialist National Motor Prosecutions team advises and represents drivers under investigation by the police and throughout criminal proceedings for motoring offences arising out of road traffic incidents. These offences range from Careless Driving to more serious offences such as Causing Death by Dangerous Driving.

We operate a 24 hour hotline that ensures your drivers receive early advice from a specialist lawyer as well as police station representation throughout England and Wales. We then assist and represent the driver and operator through all possible eventualities to ensure a seamless and consistent service. Our expertise in this area means we have established contacts within all the investigating authorities.

Our initial response

Our initial response is to make immediate contact with the Investigating police officer to obtain details regarding the collision circumstances, physical evidence at the scene, early indicators from police collision investigators in relation to the mechanics of the collision, accounts of any witnesses, details of injured parties/deceased and dependents, vehicle defect issues.

Details from the police at the scene enable us to quickly consider the risk of any potential conflict before making contact with your driver.

All people advising on client matters will be supervised by a partner or other senior lawyer. The supervisor will discuss and agree the strategy for every matter with all lawyer(s) working on a matter. Each client will be advised at the start of a matter of the name of the lawyer with day to day conduct of the matter, and their supervisor in their letter of engagement which is sent out at the beginning of our instruction.

Type of claim

The Criminal Motor Defence team regularly defend all types of criminal motoring cases in the Magistrates’ Courts and Crown Court including the most serious cases of Causing Death by Dangerous Driving involving multiple fatalities.

The team are adept in dealing with complicated expert evidence in relation to road traffic collision investigation, toxicology analysis, mobile phone and cell site analysis.

The below rates and estimates apply to matters on which we are instructed to represent individuals prosecuted for summary only driving offences in the Magistrates’ Court to be concluded in one hearing. 

Typical offences falling into this category include:

  • Driving/In charge with excess alcohol
  • Speeding
  • Use of a mobile phone whilst driving
  • Driving Without Due Care and Attention (Careless Driving)
  • Failing to Stop/Report
  • Construction and Use offences
  • Endorsable offences leading to totting disqualification and exceptional hardship / special reasons applications
  • Tachograph offences

Service information:

The fee estimate below would include:

  • Initial meeting with you to obtain the factual background and any relevant detail
  • Considering evidence
  • Providing advice in relation to plea and likely sentence
  • Advice on the options available to the court in relation to sentencing
  • Where appropriate, advice on whether an exceptional hardship, or special reasons argument should be made
  • Representation at a single hearing at the Magistrates Court

The fee estimate does not include:

  • instruction of any expert witnesses
  • taking statements from any witnesses
  • advice and assistance in relation to a special reasons hearing
  • advice or assistance in relation to any appeal

We set out below an overview of the key stages of your matter, which are based on the presumption that you have entered a guilty plea and have a date for your hearing:

  • We would have an initial meeting with you to obtain instructions on the background to the matter.
  • We will consider initial disclosure we require from you, and any other evidence to defend you and provide advice to you on merits, and process.
  • We would arrange to take any witness statements if necessary (this will have an additional cost, based on the above hourly rates dependant upon the amount of work required).
  • We will explain the court procedure to you so you know what to expect on the day of your hearing, and the sentencing options available to the court.
  • We will conduct any further preparatory work, obtain further instructions from you if necessary and answer any follow up queries you have.
  • We cannot provide a timescale of when your hearing will take place, as this depends on the court listing for that day. On average, instructions relating to the above offences would typically take 3 months from initial instruction to a court hearing, subject to court availability.
  • We will attend court on the day and meet with you before going before the court.
  • We will discuss the outcome with you. If advice is required on appeal, this will carry an additional cost.

Additional disbursements may include Counsel's fees, expert's fees, Court fees and copying charges. These costs are dependant upon seniority of Counsel, type of expert and the amount of work required. Further information may be provided on a case by case basis.

Our estimate for representing you at any of the above claims would be in the region of £1,250 to £5,000 exclusive of VAT.

The total cost of a case will depend upon the number of conferences required with a client, whether an expert is to be instructed, the amount of evidence / complexity of the case and the Court location. The above estimates are a range of indicative costs and not a fixed fee. Please contact us if you wish to obtain a more specific quote.

Cases to be defended (trials) would fall outside of these estimates.  As would either way offences which could fall to be dealt with at the Crown Court.
