Within the last few days, employers of junior doctors across the NHS have received letters from Capital Law, acting on behalf of the BMA in its legal action against the Secretary of State. The letters request details of the steps that employers have taken, or will take, to assess the equality impact of the new junior doctors' contract in their organisations. Employers have reacted with a degree of bemusement, not least because most of them have not yet recruited the intake of junior doctors who will be the first to be employed under the new contract. How can employers carry out an equality impact assessment (EIA) on an unknown group of employees?
