Turkey - Ratifies 2001 Convention Protocol

Turkey has taken a further step towards alignment with the rest of Europe by ratifying in its Ratification Law No.6705 ("Ratification Law") the 2001 amendment Protocol ("Protocol") to the 1981 Convention for the Protection of Individuals with Regard to Automatic Processing of Personal Data ("Convention"), which was ratified in Turkey in February of this year.

Crucially this means that Turkey is now required to establish a data protection authority with powers of investigation and intervention, to ensure compliance with the provisions of the Convention.

It also introduces into Turkish law restrictions around extra-jurisdictional transfers of data, with the requirement that such transfers only take place when an adequate level of protection for the data can be ensured.

To the extent that an organisation processes personal data in Turkey it should bear in mind that the provisions of the Convention and the Protocol now apply in Turkey and should be observant as this area continues to develop.
