Argentina - Argentinian DPA signals shift towards more proactive approach

The Argentinian National Directorate for Personal Data Protection ("NDPDP") has recently announced the launch of two investigations against Uber, Inc ("Uber") and Club Atletico Tigre ("Club Tigre") (a well-known sports club in Argentina) in a move that signals a more proactive approach since the organisation's reorgansiation following the presidential elections last year.
The investigation into Uber will centre around the personal data that it collects when providing services in Argentina and the security and confidentiality measures that it has implemented to protect that data.
The investigation into Club Tigre concerned its proposals to implant RFID chips into the bodies of its members, which would allow them to access the club by approaching the security doors. The NDPDP is investigating whether such a proposal would put members' privacy at risk and whether other less intrusive measures existed and had been explored.
To the extent that organisations process personal data in Argentina they should take care to ensure that such processing is compliant with the applicable data protection law in light of the more proactive approach the NDPDP is beginning to take.
