Belgian privacy commission releases cookies guidance

The Belgian Privacy Commission has released guidance on the use of cookies and similar technology (the Guidance). The Guidance provides direction as to how businesses can comply with the Belgian data protection act when using cookies.

In particular it emphasises the importance of providing clear and adequate information and obtaining consent. It also sets out specific recommendations for those setting up website on how to ensure compliance with data protection law.

What action could be taken to manage risks that may arise from this development?

Companies with presence/delivering services in Belgium should review their Belgium websites’ cookie compliance in light of the Guidance.
