The American Chamber of Commerce in China has published a spotlight report on “Protecting Data Flows in the US-China Bilateral Investment Treaty” (the Report).
The Report challenges the assumption that data security is best achieved through local storage of personal data and highlights the potential economic risks of pursuing such policies and its possible impact on innovation. It concludes that following more liberal data protection policies protect and foster international transfers of data by service providers.
