Australia: Australian Privacy Commissioner releases guidelines

Published 1 April 2015

The Office of the Australian Information Commissioner (OAIC) has released revised guidelines (the Guidelines) on the Australian Privacy Principles (the APPs). The Guidelines are the OAIC’s interpretation of the APPs and are not legally binding.

The revised Guidelines provide additional guidance on the provision of personal information to an overseas contractor and on when overseas entities will be considered to be carrying on business in Australia.

A copy of the Guidelines is available here.

What action could be taken to manage risks that may arise from this development?

Companies should take the Guidelines into account when processing personal data in Australia, particularly when engaging third party subcontractors, to ensure compliance with the APPs.
