Insurance Adviser Alert: Employees of subsidiaries may not be able to pursue a parent company - May 2014

The Court of Appeal recently considered the relationship between parent and subsidiary companies in asbestos claims in the case of Thompson v The Renwick Group plc, 13 May 2014.
The Claimant handled raw asbestos when employed by Arthur Wood & Co (Transport) Ltd and David Hall & Sons Ltd. Both companies were subsidiaries of The Renwick Group and its predecessors for two of the nine years of the Claimant's exposure. Neither company had EL insurance in place and, by the time it was presented, neither held sufficient assets to meet the claim.
