The MOJ Portal process offers significant costs savings to insurers and their insureds, but requires swift decisions on quantum and liability to be made in a changing environment. The ramifications of The Enterprise & Regulatory Reform Act are still being considered, and admissions made within the process should be expected to be binding for the life of the claim.
DAC Beachcroft Claims Limited offers a fixed cost service, whereby for the fee of £150 (plus VAT) its experienced fee earners will assess claims presented through the Pre-Action Protocol for Low Value Personal Injury (EL and PL) Claims, perform desktop investigations where appropriate and provide a written advice on liability, quantum, whether the claim will fall outside the protocol on quantum, and analyse the cost-benefit of admitting liability within the Portal or pulling the claim from its process, within 2 business days of instruction.
