Tom acts on behalf of professionals and their insurers in claims which are high value, complicated and usually involving multiple parties. Tom specialises in particular in defending claims against accountants, financial advisers, solicitors and directors and officers.
Tom has particular expertise in defending professionals in relation to claims brought in relation to failed tax planning, in particular tax avoidance schemes. Whilst accountants and financial advisers are usually primary targets, solicitors, barristers and other professionals are often drawn in too. Tom has been acting in such claims for the last ten years, albeit the frequency of such claims has recently increased due to HMRC's so-called 'clamp-down' on tax avoidance. Tom has spoken on the topic and and delivered training on many occasions, including to top five accountants. Tom has also lectured and advised in relation to Financial Reporting Council investigations.
Tom is committed to seeking out the most cost effective resolution for his clients. Tom is an experienced negotiator, and has resolved many matters through negotiation or mediation; if defending a matter to trial occasionally becomes necessary, Tom has a wealth of experience in leading and managing teams in that context. His experience includes acting in the Commercial Court as part of the team successfully defending the lead defendant in the InnovatorOne tax schemes litigation during a four month trial in 2011/2012. In 2013 Tom lead a team defending an insured firm of solicitors against allegations of under-settlement in a multi-party action that was discontinued on the third day of trial. Tom also has experience of arbitration.
Tom is regularly instructed to advise insurers on policy response, and his experience involves contentious coverage disputes, often involving multi-jurisdictional elements.
