Rosalind Ashcroft



Ros Ashcroft has many years experience of advising bodies on public sector decision-making. She advises on policies, processes and individual decisions, frequently in relation to reconfiguration of services or allocation of funding.

She has a particular interest in equalities and human rights issues in relation to public functions and services and regularly advises on consultation and engagement with service users. She is a very experienced litigator, handling judicial reviews in the High Court and the Court of Appeal. 

Ros also has a particular expertise in advising on the impact of new legislation, particularly in the health and social care sector: she advised and wrote extensively about both the Health & Social Care Act 2012 and the Care Act 2014. 

Ros's clients include national bodies such as NICE, the Higher Education Funding Council for England and NHS England, NHS bodies including CCGs and Foundation Trusts, local authorities and other bodies working with and for the public sector.

Local Government

Ros is the firm's local government lead and is a regular speaker at Lawyers in Local Government events.  She has a particular interest in the health and social care functions of local authorities, but also advises them widely on issues relating to local government functions and powers, judicial review and decision-making, information law and governance.  Ros has written  practice notes and articles for PLC and LNB on local authority health and social care functions.

Information law 

Ros has been advising on information law matters for many years.  Her work covers: 

  • Data sharing powers, protocols and agreements
  • Freedom of Information Act requests
  • Environmental Information Regulations requests
  • Subject access requests under the Data Protection Act
  • Re-use of Public Sector Information regulations
  • Patient & service user confidentiality
  • Right to privacy under Article 8 of the ECHR
  • Handling data security breaches
  • Claims for damages under the Data Protection Act 

Ros has extensive experience of Information Commissioner's Office investigations in relation to both FOIA/EIRs and DPA matters, and proceedings in the Information Rights Tribunal. 

Ros's clients in information law matters include both public sector bodies and third/ private sector bodies working with the public sector, such as the Higher Education Statistics Agency and a number of health and social care providers.
