Welcome to the DAC Beachcroft Dublin September Commercial Litigation update.

The Long Vacation is an opportunity to reflect on recent developments and to look ahead to see what is in store in the new court term. We have compiled this brief update to highlight some key developments relating to litigation in Ireland.

New Court Rules - are you up to date?

The appointment of The Hon. Mr. Justice Peter Kelly as President of the High Court was inevitably going to result in changes being made to the existing High Court List. As most readers will be aware Judge Kelly, the first judge appointed to oversee the Commercial Court, was personally responsible for driving forward efficiencies and good practice in the Commercial Court. Most practitioners would share the view that some of the lessons learned in the Commercial Court would benefit the wider High Court system.

Court of Appeal

Mr. Justice John Hedigan, has been appointed to the Court of Appeal. This vacancy arose following the appointment of Judge Kelly as President of the High Court in December 2015. The Court of Appeal has now been in operation for nearly two years. From a practitioners perspective, the Court of Appeal has been a great success.

Case to note: Jurisdiction of the Circuit Court to deal with property disputes


Previously any case relating to land which had a rateable valuation of less than €253.95 could proceed before the Circuit Court.

Transferring Data Outside the EU

On 12 July 2016, after over two years of negotiations between the EU and the US, the European Commission adopted the Privacy Shield. The Privacy Shield became effective immediately, with companies being able to self-certify with the US Department of Commerce from 1 August last.
