Hungary - Hungarian DPA releases 2015 annual report

The Hungarian Data Protection and Freedom of Information Agency (the "Agency") has released its annual report for 2015 (the "Report"). The Report shows an increase in the enforcement action taken by the Agency in 2015, something that looks set to continue given the Agency's stated priorities in 2016. The Report also shows a strong uptake on Binding Corporate Rules approvals, which were only introduced in Hungary in October last year.

The focus of the enforcement action detailed in the Report provides guidance to organisations as to where the Agency is most likely to concentrate its enforcement resources. They include: i) the data processing activities of debt collection agencies; ii) product presentation events; and iii) data processing for telemarketing purposes.

The Report also shows a trend of increasing fines imposed by the Agency, with the total fines in 2015 being HUF 94 million (c. EUR 300,000), more than double the amount of fines issued in 2014. This trend looks set to continue in 2016, particularly with the maximum fine amount increased from HUF 10 million to HUF 20 million in October of last year.

Organisations operating in Hungary should take account of the Agency's areas of focus particularly in relation to any telemarketing activities, to ensure it does not become subject to enforcement action which now bears the risk of increased fines.
